Terms and Conditions
1. General
1.1 These terms apply to all visitors and users of SPLASH Art Studio located in Hong Kong.
1.2 SPLASH reserves the right to modify these terms at any time without prior notice. Changes will be effective immediately upon posting.
2. Conduct
2.1 All visitors must conduct themselves in a respectful manner.
2.2 Any form of vandalism, theft, or disruptive behavior will result in immediate removal from the premises and potential legal action.
3. Liability Waiver
3.1 Assumption of Risk: By participating in activities at SPLASH Art Studio, you acknowledge and assume all risks associated with art-related activities, including but not limited to, risks of injury from equipment malfunction or accidents.
3.2 Waiver of Claims: You agree to waive any and all claims against SPLASH, its directors, officers, employees, agents, and representatives (collectively, "the Releasees") for any loss, damage, injury, or expense that may arise from your participation, due to any cause whatsoever.
3.3 Release and Indemnity: You release the Releasees from any liability and agree to indemnify them against all claims, suits, costs, and expenses, including attorney's fees, arising from your participation in studio activities.
3.4 Binding Effect: This waiver is binding upon your estate, heirs, representatives, and assigns.
4. Bookings and Payments
4.1 All bookings must be made in advance and are subject to availability.
4.2 Payments are subject to the cancellation policy. In the event of a studio-initiated cancellation, a full refund will be provided.
5. Cancellation Policy
5.1 Same-Day Cancellations: 20% refund of the total booking fee.
5.2 Cancellations One Day in Advance: 40% refund of the total booking fee.
5.3 Cancellations Two or More Days in Advance: Full refund.
5.4 Special Events: Different terms may apply. Refer to specific event terms and conditions.
6. Health and Safety
6.1 Visitors must follow all health and safety guidelines provided by SPLASH staff.
6.2 In case of an emergency, please follow the instructions of SPLASH personnel.
7. Privacy and Media
7.1 SPLASH respects the privacy of its visitors. Personal information collected will be used solely for providing services and will not be shared without consent.
7.2 By participating, you consent to the use of your image in photos or videos taken during activities for promotional purposes.
8. Governing Law
8.1 These terms are governed by the laws of Hong Kong. Any disputes will be subject to the exclusive jurisdiction of the courts of Hong Kong.
8.2. I expressly agree that the Terms and Conditions is intended to be as broad and inclusive as is permitted by the law of HKSAR in which the service is conducted, and that if any portion thereof is held invalid, it is agreed that the balance shall nevertheless, continue in full legal force and effect and be binding upon me.
